On Wednesday, September 28, 2016, firm estate planning attorney Phil Peterson attended a continuing legal education estate planning seminar in Boise entitled “Retrospective Testamentary Capacity: An Approach to Assessment.” The speaker was Camille LaCroix, M.D., FAPA, a forensic psychiatrist with Forensic Psychiatry Services of Idaho, PLLC., who discussed approaches to post-death assessment of a testator’s/testatrix’s testamentary capacity, including case studies based on probate litigation in which she had participated as an expert witness. Mr. Peterson is a 37-year member, past president, and current treasurer of Southwest Idaho Estate Planning Council, and this seminar constituted the September meeting of the group.
